Introduction
This Privacy Policy explains how Dessertini (“Dessertini,” “we,” “us,” or “our”) collects, uses, shares, and protects personal information when you visit https://dessertini.ca (the “Site”) or submit an inquiry to us.
Dessertini is a boutique dessert and dessert-catering brand based in Markham, Ontario, serving the Greater Toronto Area. We make layered desserts served in martini glasses, which we call “cuptinis.”
We respect your privacy and collect only the information we need to respond to and fulfil your inquiries. This policy is written in plain language so you can understand exactly what we do with your information. It is governed by the laws of the Province of Ontario and Canada, and we handle personal information in accordance with the federal Personal Information Protection and Electronic Documents Act (PIPEDA).
By using the Site or submitting an inquiry, you agree to the practices described in this policy.
What Information We Collect
We keep data collection to a minimum. The only personal information we collect comes from the inquiry form on our Site. When you submit an inquiry, we collect:
- Your name (required)
- Your email address (required)
- Your phone number (required)
- Event date (optional)
- Event time (optional)
- Guest count (optional)
- A free-text message (optional)
- Your cuptini selection (the items you’ve chosen)
In addition to the form details above, we also process:
- Your IP address — briefly, for spam prevention only. When you submit the form, your IP address is processed temporarily in server memory to limit spam and abuse (rate-limiting). It is not stored long-term and is not used to identify or track you.
- First-party browser local storage — stored only on your own device. Our Site uses your browser’s local storage to remember your cuptini selection (your “cart”) so it’s still there if you come back. This information stays on your device, is not transmitted to us for tracking, and is not shared with anyone. See the “Cookies and Local Storage” section below for more detail.
We do not collect any payment or financial information through the Site. The Site is not an online store and has no checkout or payment processing.
How and Why We Use Your Information
We use the personal information you provide for these purposes only:
- To respond to your inquiry — to contact you and confirm your event date, flavours, quantities, delivery details, and pricing.
- To fulfil your order once it is confirmed directly with you.
- To prevent abuse — your IP address is briefly used to protect the Site from spam and automated submissions.
An inquiry is a request for us to follow up — it is not a binding order until we confirm it with you. We use your contact details to have that conversation and to serve you. We do not use your information for advertising, profiling, or automated decision-making.
Legal Basis and Your Consent (PIPEDA)
Under PIPEDA, we collect, use, and disclose personal information based on your consent and only for purposes that a reasonable person would consider appropriate.
When you submit the inquiry form, you are giving us your consent to use the information you provided to respond to and fulfil that inquiry. We identify this purpose clearly at the point of collection, and we limit our collection to what is necessary for it.
Marketing (CASL): We will not send you promotional or marketing emails without your separate, express consent. The contact details you give us through the form are used only to respond to and fulfil your own inquiry. If we ever wish to send you marketing messages, we will ask for your express consent first, in keeping with Canada’s Anti-Spam Legislation (CASL), and you will be able to withdraw that consent at any time.
You may withdraw your consent at any time (see “Your Privacy Rights” below). If you withdraw consent, we may no longer be able to respond to or fulfil your inquiry.
How Your Information Is Shared
We do not sell, rent, or trade your personal information. Ever. We share your information only as needed to operate, in the following limited ways:
- Our email and web partner, The Scroll Studio. When you submit the form, your inquiry is sent to us by email. This email is processed using Dessertini’s email service provider infrastructure, which is operated by our web partner, The Scroll Studio, and is delivered to a private inbox that we control. The Scroll Studio acts as our service provider for the limited purpose of operating the Site and delivering your inquiry to us. Under PIPEDA’s accountability principle, Dessertini remains responsible for your personal information even when it is handled by our service provider on our behalf.
- Where legally required. We may disclose information if we are required to do so by law, regulation, legal process, or an enforceable governmental request.
Other than the above, we do not disclose your personal information to any third party.
Data Retention
We keep your personal information only for as long as we need it to respond to and serve your inquiry. Once your inquiry has been handled — and once any related order has been completed — we delete or archive the information when it is no longer needed for the purpose it was collected for, or to meet any legal or record-keeping obligation.
Your IP address is processed only briefly in server memory for spam prevention and is not retained long-term.
How We Protect Your Information
We use reasonable physical, technical, and organizational safeguards to protect your personal information against loss, theft, and unauthorized access, use, or disclosure. These safeguards are appropriate to the sensitivity of the information we hold. In particular, email containing your inquiry is delivered over encrypted transport, and access to the private inbox is restricted.
No method of transmitting or storing information is completely secure, so while we work hard to protect your information, we cannot guarantee absolute security.
Your Privacy Rights
Under PIPEDA, you have the right to:
- Access the personal information we hold about you.
- Correct any personal information that is inaccurate or incomplete.
- Withdraw your consent to our use of your information, subject to legal or contractual limits (note that withdrawing consent may prevent us from responding to or fulfilling your inquiry).
- Ask questions or make a complaint about how we handle your personal information.

Cookies and Local Storage
We want to be clear about this: our Site does not track you.
- We do not use tracking cookies.
- We do not use analytics.
- We do not use advertising or marketing cookies.
- We do not use social media pixels or any third-party trackers.
The only thing we store on your device is first-party local storage — a small amount of data saved by your own browser to remember your cuptini selection (your “cart”) so it’s there when you return. This information stays on your device. It is not transmitted to us for tracking purposes and is not shared with anyone.
Because we use local storage only for this functional purpose, and because nothing on our Site tracks you across the web, no cookie consent banner is required. You can clear this stored data at any time through your browser settings (for example, by clearing your browser’s site data or local storage for https://dessertini.ca). Clearing it will simply remove your saved cuptini selection.
Children’s Privacy
Our Site is not directed at children under the age of 13, and we do not knowingly collect personal information from children. If you believe a child has provided us with personal information, please contact us at [email protected] and we will delete it.
Changes to This Policy
We may update this Privacy Policy from time to time, for example to reflect changes in our practices or in the law. When we do, we will revise the “Last updated” date at the top of this page. We encourage you to review this policy periodically.
