Acceptance of These Terms

These Terms of Use (“Terms”) govern your access to and use of https://dessertini.ca (the “Site”), operated by Dessertini (“Dessertini,” “we,” “us,” or “our”). By accessing or using the Site, or by submitting an inquiry to us, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use the Site.

Please read the Food Allergen and Safety Disclaimer below carefully — it is important to your health and safety.

About the Site

Dessertini is a boutique dessert and dessert-catering brand based in Markham, Ontario, serving the Greater Toronto Area. We make layered desserts served in martini glasses, which we call “cuptinis.”

The Site is informational and inquiry-based. It is not an online store. There is no checkout, no payment processing, and no way to place a binding order directly on the Site. Instead, you can browse our cuptinis and submit an inquiry, and we will follow up with you directly.

Inquiries and Orders

When you submit the inquiry form, you are sending us a request — not placing a binding order.

  • An inquiry is not a contract. Submitting an inquiry does not create a binding agreement between you and Dessertini.
  • Orders are confirmed directly with us. Your order — including flavours, quantities, delivery or pickup details, dates, and pricing — is confirmed directly with Dessertini by message after you inquire. An order becomes confirmed only when we communicate that confirmation to you.
  • Pricing. Prices shown on the Site are per individual cuptini and are subject to change at any time. Final pricing is confirmed when we respond to your inquiry. Events and bulk orders may be eligible for discounted pricing, which we will discuss with you directly.
  • Availability. All orders are subject to our availability for your requested date and to our acceptance.

Food Allergen and Safety Disclaimer

Please read this section carefully. It affects your health and safety.

  • Our cuptinis contain dairy, egg, and gluten. Some cuptinis contain additional allergens — for example, the Oreo Parfaitini also contains soy.
  • Cross-contact is possible. Our products are prepared in a kitchen that handles common allergens, including (but not limited to) dairy, egg, gluten, soy, and nuts. We cannot guarantee that any product is free from any particular allergen.
  • You must tell us about allergies and dietary restrictions. When you inquire, you are responsible for informing us of any allergies, sensitivities, or dietary restrictions that apply to you or your guests. We cannot accommodate what we do not know about.
  • Limitation regarding undisclosed allergies. To the fullest extent permitted by law, Dessertini is not responsible for any adverse reaction where the relevant allergy, sensitivity, or dietary restriction was not disclosed to us before your order was confirmed.
  • Storage and consumption. Our cuptinis are perishable. Please consume them promptly and refrigerate them as advised. We are not responsible for issues arising from improper storage or handling after the product has been delivered to or picked up by you.

Intellectual Property

All content on the Site — including our brand name, logos, designs, images, photographs, text, and other materials (collectively, the “Content”) — is owned by Dessertini or used by us with permission, and is protected by applicable intellectual property laws.

You may not copy, reproduce, distribute, modify, republish, or otherwise use any of the Content without our prior written permission. You may view and share the Site for your own personal, non-commercial use.

Acceptable Use

When using the Site, you agree that you will not:

  • Use the Site for any unlawful, fraudulent, or harmful purpose.
  • Submit false, misleading, or abusive information through the inquiry form.
  • Attempt to interfere with, disrupt, or gain unauthorized access to the Site, its servers, or any related systems.
  • Use automated means (such as bots or scrapers) to access or submit information to the Site, or otherwise attempt to overload or abuse the inquiry form.
  • Use the Content in any way that infringes our intellectual property rights or the rights of others.

Third-Party Links

The Site may contain links to third-party websites or platforms, such as our Instagram page. These links are provided for your convenience only. We do not control these third-party sites and are not responsible for their content, policies, or practices. Visiting a linked third-party site is at your own risk, and we encourage you to review that site’s own terms and privacy policy.

Disclaimer of Warranties

The Site and its Content are provided on an “as is” and “as available” basis, without warranties of any kind, whether express or implied, to the fullest extent permitted by law. We do not warrant that the Site will be uninterrupted, error-free, secure, or free of harmful components, or that any information on the Site is complete, accurate, or current.

Information about our cuptinis on the Site is provided for general informational purposes. Final details — including ingredients, flavours, availability, and pricing — are confirmed when we respond to your inquiry.

Limitation of Liability

To the fullest extent permitted by the laws of the Province of Ontario, Dessertini will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss arising out of or in connection with your use of (or inability to use) the Site, your reliance on any Content, or any inquiry or order, even if we have been advised of the possibility of such damages.

Nothing in these Terms limits or excludes any liability that cannot be limited or excluded under applicable law, including under Ontario consumer protection legislation.

Indemnity

You agree to indemnify and hold Dessertini harmless from any reasonable claims, losses, or expenses arising out of your misuse of the Site, your breach of these Terms, or your violation of any law or the rights of any third party.

Changes to These Terms

We may update these Terms from time to time. When we do, we will revise the “Last updated” date at the top of this page. Your continued use of the Site after any changes means you accept the updated Terms. We encourage you to review these Terms periodically.

Governing Law

These Terms are governed by and interpreted in accordance with the laws of the Province of Ontario and the laws of Canada that apply there, without regard to conflict-of-law rules. You agree that any dispute relating to the Site or these Terms will be subject to the exclusive jurisdiction of the courts of the Province of Ontario.
